As the demand for employment is increasing day by day, signing electronic labor contracts attracts a great deal of attention from both enterprises and employees, especially after the Covid-19 outbreak. In Vietnam, although regulations concerning electronic contract have first appeared in the 2005 Law on Electronic Transactions, those rules have been specifically stipulated in the Labor Code till 2019. Accordingly, since 1 January 2021, the date on which the 2019 Labor Code took effect, employers and employees in Vietnam have been able to officially sign electronic labor contract in the form of electronic data. This legal article shall provide the specific conditions for signing electronic labor contracts pursuant to the regulations of Vietnamese law, along with the assessment to both advantages and disadvantages of such type of contracts.
